Your Marital Situation Will Determine How You File

Whether you file for a contested or uncontested divorce is often dependent on the particular circumstances of your marital situation. There are four marital situations in which you can file for an uncontested divorce. In all other situations you will probably have to go through a contested divorce.

Listed below are the four marital situations which lend themselves to an uncontested divorce filing. For each situation check the boxes that apply. If you check all (3) three boxes for any situation then you can file an uncontested divorce. Start with Situation 1.

Situation 1

Situation 2

Situation 3

Situation 4

Congratulations! If you checked the 3 boxes in Situation 4 then you can get your divorce filed and completed. However, because your spouse will not cooperate with the process there are special court procedures that will need to be used to get the divorce. Contested Divorce
