JUDGMENT OF DIVORCE


THIS MATTER having been opened to the Court before the Honorable _______________________,J.S.C., on the _____ day of ___________201__, in the presence of Brian D. Iton, Esq., attorney for plaintiff, (PLAINTIFF’S NAME),; defendant not appearing in Court; and the court having heard and considered the proofs in this action, and it appearing that the plaintiff and defendant were joined in the bond of matrimony on the ____th day of ________ 20____, and the plaintiff having pleaded and proved a cause of action for divorce as set forth and defined by N.J.S.A. 2A: 34-2(i) as alleged in the Complaint, and it further appearing that at the time the cause of action arose, plaintiff was a bona fide resident of this State and that plaintiff continued to be down to the time of commencement of this action, and that plaintiff had been a bona fide resident of the state more than one year next preceding the commencement of this action, it further appearing that jurisdiction over the defendant having been acquired pursuant to the Rules; and IT FURTHER appearing that the parties entered into a written Interspousal Property Settlement Agreement dated and executed on ______ ____th, 201___, which agreement was introduced into evidence as ____-1; and IT FURTHER appearing that plaintiff having testified that he/she had entered into the Agreement voluntarily with the benefit of independent counsel, and that he/she understood all the terms of said Agreement; and for good cause shown; IT IS THEREFORE, on this ____th day of __________ 201___, by the Superior Court, Chancery Division, County of ___________, State of New Jersey; ORDERED AND ADJUDGED, and such Court, by virtue of the power and authority of this Court, and of the Acts of the Legislature in such case made and provided, does hereby ORDER AND ADJUDGE that said plaintiff, (PLAINTIFF’S NAME), be divorced from the bond of matrimony from the said defendant, (DEFENDANT’S NAME), pursuant to the statute in such case made and provided; and that said parties and each of them be freed and discharged from the obligations thereof; and; IT IS FURTHER ORDERED AND ADJUDGED that the Interspousal Agreement dated _______________, 201___, between the parties is hereby made a part of this Judgment of Divorce and shall not merge with, but shall survive this Judgment of Divorce; and IT IS FURTHER ORDERED AND ADJUDGED that the parties comply with each and every obligation to which they have subscribed as fully appears in the written Interspousal Agreement dated ____________, 201___ with the same effect as if each and every obligation contained in said Agreement herein was specifically set forth above. The Interspousal Agreement is neither approved nor disapproved, but Is made a part of this Judgment at the request of the parties who are directed to abide by its terms. All issues pleaded and not resolved in this judgment are deemed abandoned. Plaintiff to serve a copy of this Judgment of Divorce on Defendant within 7 days.
