There are four marital situations in which you can file for an uncontested divorce. In all other situations you will probably have to go through a contested divorce.

Situation 1.

You and your spouse have no marital issues to resolve (no children, no child custody issues, no child support to be calculated, no alimony to discuss, no property to divide, no debt to split up, etc.,)

Your Spouse Will Cooperate with the Divorce Process

Situation 2.

You and your spouse have no marital issues to resolve (no children, no child custody issues, no child support to be calculated, no alimony to discuss, no property to divide, no debt to split up, etc.,)

Congratulations! If you checked the 3 boxes in Situation 4 then you can get your divorce filed and completed. However, because your spouse will not cooperate with the process there are special court procedures that will need to be used to get the divorce. CONTESTED DIVORCE
